These Terms of Service ("Terms") govern your use of the SpyMobile website at spymobile.app and the SpyMobile application (the "Service"), operated by SpyMobile ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and manage a family circle. By using the Service you represent that you meet this requirement and have the authority to consent to these Terms.
The Service is intended for lawful family use only — for parents monitoring their own minor children and for family members who have consented to share their location. You agree that you will not use the Service to track, monitor, or surveil any person without their knowledge and consent, and you will comply with all applicable laws, including those relating to privacy and electronic surveillance. Using the Service to stalk, harass, or harm any person is strictly prohibited and may be illegal.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate information and keep it up to date.
Some features require a paid subscription. Paid plans may include a free trial; unless cancelled before the trial ends, the plan converts to a paid subscription. Subscriptions renew automatically until cancelled. You can cancel at any time, and cancellation takes effect at the end of the current billing period. Fees are non-refundable except as described in our published refund practices or required by law.
We may offer a free tier with limited features. We reserve the right to modify, suspend, or discontinue any part of the Service, including plan features and pricing, with reasonable notice where required.
The Service, including its software, design, text, and logos, is owned by SpyMobile and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal family use. You may not copy, modify, reverse engineer, or resell any part of the Service.
You retain ownership of content you submit, such as place names and messages. You grant us a license to use such content solely to operate and improve the Service. You are responsible for ensuring your content does not violate any law or third-party rights.
The Service may link to or rely on third-party services (such as map providers and payment processors). We are not responsible for the content or practices of third parties, and your use of them is governed by their terms.
The Service is provided "as is" and "as available" without warranties of any kind. Location data may be inaccurate or delayed, and the Service is not a substitute for emergency services, supervision, or your own judgment. In an emergency, always contact local emergency authorities. We do not guarantee uninterrupted or error-free operation.
To the maximum extent permitted by law, SpyMobile shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from reliance on location data or the unavailability of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.
You agree to indemnify and hold harmless SpyMobile from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms, including any use of the Service to monitor a person without consent.
We may suspend or terminate your access if you violate these Terms or use the Service unlawfully. You may stop using the Service and delete your account at any time.
These Terms are governed by the laws applicable in our place of operation, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. Continued use of the Service after changes means you accept the updated Terms.
